    APPLEBY MAGNA, LEICESTERSHIRE — A 36-year-old man has been found guilty of manslaughter following a fatal altercation outside a pub in Appleby Magna on December 21, 2025. Nathan Gothard was convicted after an incident in which he punched David Darke, a grandfather, who had tried to help him during a confrontation outside the Crown Inn. Darke died six days later in the hospital due to severe head injuries.

    The jury at Leicester Crown Court found Gothard not guilty of murder but convicted him of manslaughter, with the judge highlighting Gothard’s role in creating a “menacing, threatening” atmosphere inside the pub prior to the fatal altercation.

    The Evening That Led to Tragedy

    The court was told that Gothard, who had arrived at the pub earlier in the evening, began behaving aggressively and inappropriately towards members of a Christmas party that had arrived around 7 p.m. From making unwelcome remarks to female guests to claiming the pub as “his terrain,” Gothard’s behavior escalated as the night went on.

    By 9 p.m., Gothard’s disruptive actions led to the pub’s landlady and her partner intervening. They managed to escort him outside in an attempt to de-escalate the situation. Instead of going home, Gothard continued his confrontations with others, heading toward the front of the pub where the party guests were leaving.

    The Fatal Punch

    David Darke, who was not involved in the altercation but had seen Gothard’s behavior, stepped in to help. Darke tried to pull Gothard to his feet after Gothard had fallen during the dispute. In response, Gothard, in a fit of rage, struck Darke with such force that it caused the injuries that would later prove fatal. Darke sustained traumatic head injuries from the punch and fell to the ground.

    Despite the medical intervention and being taken to the hospital, Darke tragically passed away from his injuries six days later.

    Gothard had claimed that he acted in self-defense after Darke allegedly threatened him, stating that Darke had made threats such as “I’m going to kill you and bury you.” However, the jury sided with the prosecution’s argument, emphasizing that Gothard’s actions were unprovoked and dangerous.

    Defense Argument: Gothard’s Feelings of Ridicule

    Gothard’s defense team argued that he was not the aggressor and suggested that he had been ridiculed inside the pub. His barrister argued that while Gothard may have behaved poorly, he was not responsible for starting the altercation with Darke. They stressed that Gothard had no previous conflict with Darke and that the alleged threats from Darke, confirmed by witnesses, may have justified Gothard’s actions.
